Effective: September 8, 2015
iCommute, Inc., a Delaware corporation, doing business as RidePal ("RidePal", “we” or “us”) is committed to protecting your privacy and informing you about how your information is used. In order to provide you with the RidePal service (the "Service"), we need to collect certain information about you, and your social network. This Privacy Policy describes what personal information we collect from you, how we collect it, and how we use it. We will not use or share your information with anyone except as described in this Privacy Policy. This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources.
If you have questions or concerns regarding this Privacy Policy, you should contact us at privacy_matters@ridepal.com .
You provide us information about yourself, including your name, home address, work address, email address, billing information, personal preferences. If you link your account with social services like Facebook, we may have access to your social graph. This information is used to plan routes, offer more rides, notify you of changes in our offering and provide you with a better rider experience. As further explained below, in the course of providing you with additional services you may request related to RidePal, we may use the personal information we have collected about you in partnership with outside companies, with your permission. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses. We may also retain any messages you send through the Service.
In most instances, RidePal staff will have access only to aggregate information in the course of providing the Service to you. Some examples of exceptions include:
RidePal may collect your personal payment information, such as credit card information and including information stored on outside services that you may use with RidePal, such as PayPal. By submitting your payment information and/or linking your RidePal account with an outside payment service such as PayPal, you authorize RidePal to access and use this information in order to provide you with and accept payment for the Service. This allows us to both confirm your identity and provide you with seamless, hassle-free transactions. Please be aware that we are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our site and to read the privacy statements of each and every website that collects personally identifying information.
RidePal sends a "cookie" to your computer or smart phone that contains an identification number that is unique to the device you are using. We use this cookie to provide you with a seamless experience, and so that we can record how our service is being used. A cookie does not collect personal information about you, but may convey anonymous information about how you browse the Service to us. A persistent cookie remains on your hard drive after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the site. Persistent cookies can be removed by following your web browser's directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Service may not function properly if the ability to accept cookies is disabled.
As is true of most Web sites, we gather certain information automatically and store it in log files. We log each visit to each web page on the Service, either directly or through a provider of such tracking solution. A log entry can contain information typically found in the "header" of your web browser's request such as the browser type you used, your Internet Protocol address, and the date and time of day. We may also log your cookie's identification number and the URL of the last site you visited. If you login, we may also log how you use the system, such as the number of tickets you have bought in a given session. This log information is important for security, audit, quality improvement, as well as for monitoring the health of our Service. Your IP address may serve to monitor network access and response time, diagnose problems with our website or mobile application, and gather aggregate demographic data such as the geographic distribution of our traffic. We do not tie IP addresses to our customers' personally identifying information.
In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened by recipients. The information is used to enable more accurate reporting, improve the effectiveness of our marketing, and make RidePal better for our users. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Internet users. Clear gifs are embedded invisibly in web pages or emails. We do not tie the information gathered by clear gifs to our customers' personally identifying information.
The kit that we may install in RidePal vehicles allows us to gather information about vehicle use, including but not limited to time of use, times at stops, number of people that boarded or left the vehicle at any given stop, real-time position, speed of travel, and other aspects of vehicle use. We may use this information (i) to provide you with the Service, (ii) to aggregate your use habits and potentially provide you with related benefits such as better route, (iii) to record vehicle movements and driver behavior in case of traffic complications, and (iv) to aggregate your data with other riders' data and better understand how people use our Service and how we can make it even better for you in the future.
The location of all RidePal vehicles is tracked by a global positioning system (GPS) in the vehicle kit and conveyed to RidePal, and may be communicated to selected riders. Your location information may be gathered by RidePal mobile application, with your explicit permission. Except as described in this paragraph, we will never use this information to make your individual real-time or historical location or movements public without your permission. Other users will not be able to see your movements or planned trips in a RidePal shuttle unless you choose to enable community features and share this information with a selected number of people such as your Facebook friends, or your co-workers. Personal location information will be used only to provide the Service to you. For example, it may allow RidePal to tell you how far you are from your shuttle stop. Location information, including personal location information may be released to insurance companies, the police, or similar parties in the due course of investigating and processing accident claims, and providing you with help in the case of an emergency. RidePal may publish aggregate location information, or information derived from it such as traffic patterns.
Following termination or deactivation of your account, RidePal may retain your profile information and user content for a commercially reasonable time for backup, archival, or audit purposes, or to maintain and improve the Service. Furthermore, RidePal may retain and continue to use indefinitely all information (including user content) contained in your communications to other users or posted to public or semi-public areas of the Service after termination or deactivation of your member account. Any personal information or content that you voluntarily disclose for posting to the Service, such as user content, becomes available to the public, as controlled by any applicable privacy settings. For example, if you post comments on the RidePal blog, you should be aware that any personally identifying information you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. We are not responsible for the personally identifying information you choose to submit in our blogs. If you remove information that you posted to the Service, copies may remain viewable in cached and archived pages of the Service, or if other users have copied or saved that information.
As a general policy and subject to the exceptions listed herein, RidePal does not rent or sell your personally identifying information to others. We may store personal information in locations outside the direct control of RidePal (for instance, on servers or databases co-located with hosting providers). If we do share your personally identifiably information with third parties, such third parties' use of your information will be bound by terms substantially similar to this Privacy Policy. As we develop our business, we may buy or sell assets or business offerings. Customer, email, and visitor information, which may include personally identifying information, is generally one of the transferred business assets in these types of transactions. We may also transfer or assign such personally identifying information in the course of corporate divestitures, mergers, or dissolution.
Except as set forth herein with regard to expanded services and transfer of assets, RidePal does not disclose personal information to any third party unless required to do so by law or subpoena or if we believe that such action is necessary to (i) conform to the law, comply with legal process served on us or our affiliates, or our partners, or investigate, prevent, or take action regarding suspected or actual illegal activities; (ii) to take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our site; or (iii) to exercise or protect the rights, property, or personal safety of RidePal, our users or others.
In the course of providing you with additional services you may request related to RidePal, we may use the personal information we have collected about you in partnership with outside companies, but only with your permission. When you purchase, register, or otherwise express interest in a product or service offered by a third party through RidePal, we will ask for your consent before sharing your personal information with those parties for the purpose of delivering the expanded services. For example, RidePal may partner with third party transportation providers to allow you to travel outside of the regularly scheduled shuttles on occasion. Your first name and current location would be communicated to this third-party. Such third parties are authorized to use information that is disclosed to them, in accordance with contracts and agreements between RidePal and these third parties. In these cases we will share only the information reasonably needed to provide you with said service. Information that is shared with third parties is subject to the privacy policies of those parties, which may differ from RidePal's privacy policies. RidePal is not liable or responsible for the actions or inactions of third parties.
We may share non-personally identifying information (including, but not limited to, anonymous usage data, number of votes on upcoming routes, and number of rides on a given route) with interested third parties to help them understand the usage patterns of certain RidePal services. For example, we may share fill rate information on the routes that they operate with transportation providers to help support their business decision. We may state the total number of daily riders that RidePal is supporting to members of the press.
RidePal uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information and implement your privacy settings. We cannot, however, ensure or warrant the security of any information you transmit to RidePal, and you do so at your own risk. Once we receive your transmission of information, RidePal makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting access to your account. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from RidePal, at all times. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. If you have any questions about security on our website, you can send email us at support@ridepal.com.
In the event that personal information is compromised as a result of a breach of security, RidePal will promptly notify those persons whose personal information has been compromised, in accordance with the notification procedures set forth in this Privacy Policy, or as otherwise required by applicable law.
If you have an account with RidePal, you can change your account information and preferences at any time by logging onto your account. You have the right to request and review information that RidePal holds about you, and the right to request changes to correct inaccuracies by contacting support@ridepal.com. When practical and possible, RidePal will make these requested changes.
Protecting the privacy of young children is especially important. For that reason, RidePal does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register as account holders. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 is allowed to provide any personal information to or on RidePal. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible, and we will promptly terminate such user's account. If you believe that we might have any information from or about a child under 13, please contact us at privacy_matters@ridepal.com.

Please remember that when you use a link to go from the Service to another website, our Privacy Policy is no longer in effect. Your browsing and interaction on any other website, including those that have a link on our website, is subject to that website's own rules and policies.
